These Terms of Service constitute a legally binding agreement (“Agreement”) between you and Nqalat, Inc., its parents, subsidiaries, representatives, affiliates, officers, and directors ("Nqalat ," "we," "us," or "our") governing your use of the Nqalat applications, websites, technology, and platform (collectively, the “Nqalat Platform”).

If you do not agree to be bound by these terms and conditions, you may not use or access the Nqalat Platform or any services provided through it.paste.txt

The Nqalat Platform

The Nqalat Platform is a marketplace connecting people seeking transportation (“Riders”) with transportation options to their destinations. Riders may request taxi rides from drivers (“Drivers”) who are available via the Platform. All decisions to offer or accept rides are made at the sole discretion of Drivers and Riders. Once a Rider accepts a Driver’s offer for a ride, a separate agreement is formed for that trip.paste.txt

Eligibility

The Nqalat Platform may only be used by individuals fully able and competent to satisfy the terms of this Agreement. Minors under 18 may not ride without a parent or legal guardian. Users may only create one account and must be the sole authorized user of that account.paste.txt

Charges and Payments

Use of the Nqalat Platform to request or provide rides may result in charges (“Charges”). Charges include fares and other applicable fees, surcharges, taxes, and tips. Pricing is determined and may be modified at any time and is quoted at the time of ride request or set by regional policies. Fares may be quoted or variable based on distance and time. Minimum fares may apply. Additional fees, such as cancellation, damage, or abuse fees (up to $250), may also apply. All payments are facilitated through a payment processor and are final, except as required by law. No refunds will be provided except as legally required.paste.txt

Driver Payments

Drivers will receive payment for services as specified in the Driver Addendum, which forms part of this Agreement.paste.txt

 

Driver Obligations

Drivers must have a valid driver’s license, legal authorization, medically fit status, insurance, and a vehicle in good operational condition. Riders or goods cannot exceed the safe capacity of the vehicle. Drivers must not operate as public or common carriers, accept cash outside Platform, or attempt fraudulent activity or discrimination. Drivers must address reasonable accommodations for Riders with disabilities as required by law.

Privacy and Data Protection

Nqalat  collects, uses, and retains User data necessary to provide the Platform and maintains a Privacy Policy governing its use. Data may be shared as required by law or to provide services. Users may access or request deletion of their personal data subject to legal exceptions. Data about Rider and Driver interactions, locations, and devices is collected and retained for business, safety, and legal purposes.

Communications

By using the Nqalat Platform, you agree to receive communications related to Platform operations, payment, and safety via SMS, email, or push notifications. Promotional communications may be opted out by following in-app instructions.paste.txt

Intellectual Property

All rights in the Nqalat Platform, including marks and content, are owned by Nqalat. User submissions are non-confidential and become property of Nqalat . Drivers may not misuse or display Platform marks except as provided or required by law.

Limitation of Liability

Nqalat is not responsible for the conduct of Riders or Drivers, safety or completion of rides, or lost personal belongings. The Platform is provided “as is” with no warranty, express or implied. Liability for damages arising out of Platform use is limited to the fullest extent permitted by law.

Indemnity

Users agree to indemnify Nqalat from any claims or damages resulting from breach of the Agreement, violation of laws, or misuse of the Platform.

Arbitration and Dispute Resolution

Any disputes arising out of or relating to this Agreement will be resolved by binding and final arbitration on an individual basis. Waiver of jury trial and class actions applies except as otherwise permitted by law.

Term and Termination

This Agreement is effective upon acceptance and may be terminated by either party for cause or upon material breach. Nqalat may deactivate accounts or restrict access to services if required for safety, regulatory, or business reasons.

Governing Law

This Agreement is governed by the laws of the State of California, as applicable. Severability and assignment provisions apply as stated in the full Agreement text.
